A child who has been legally adopted may be eligible to apply for Canadian citizenship if at least one adoptive parent was a Canadian citizen at the time the adoption was finalized.
Canadian law allows eligible adoptive parents to pass on Canadian citizenship to an adopted child, provided specific legal requirements are met and eligibility is confirmed by Immigration, Refugees and Citizenship Canada (IRCC).
Who Can Pass on Canadian Citizenship?
An adoptive parent may pass on Canadian citizenship to an adopted child if at least one adoptive parent:
-
Was born in Canada, or
-
Was a naturalized Canadian citizen at the time the adoption was finalized
The adoption must meet Canadian legal requirements and must not have been entered into primarily for the purpose of acquiring immigration or citizenship status.
What Does Canadian Citizenship Provide for an Adopted Child?
Once granted, a Canadian Citizenship Certificate allows your child to:
-
Live in Canada without immigration restrictions
-
Study in Canada without a study permit
-
Work in Canada without a work permit
The Canadian Citizenship Process for an Adopted Child
Applying for Canadian citizenship for an adopted child generally involves two key stages:
1. Confirmation of the Adoptive Parent’s Canadian Citizenship
This step confirms that at least one adoptive parent was a Canadian citizen at the time the adoption was finalized.
2. Citizenship Application for the Adopted Child
Immigration, Refugees and Citizenship Canada (IRCC) assesses whether the adopted child qualifies for a direct grant of Canadian citizenship under section 5.1 of the Citizenship Act, based on the adoption, family relationship, and supporting documentation.
Eligibility is determined solely by IRCC based on legislation and policy in effect at the time of assessment.
